4. Data Sharing and Disclosure

We do not sell, trade, or otherwise transfer your personal information to third parties except in the following circumstances:

  • Service Providers: We share data with Stripe for payment processing, Google for authentication, Cloudflare for content delivery and storage, and Fal.ai for AI image generation.
  • Visual-Discovery Platforms: Where a design has been marked Discoverable (see Section 5), we may distribute the design and a limited set of associated metadata to connected third-party platforms, including Pinterest, for the purposes of inspiration, discovery, and promotion of the Service.
  • Legal Requirements: When required by law or to protect our rights.
  • Business Transfers: In connection with a merger or acquisition.
  • Consent: With your explicit consent.

5. Public Designs and Discoverability

5.1 Default Visibility

Tattoo designs you generate through the Service are, by default, marked as "Discoverable." A Discoverable design — together with the textual prompt you supplied to generate it and the style or other parameters you selected — may be displayed on publicly accessible pages of the Service (including, without limitation, our explore galleries, per-design detail pages, and category pages) and may be further distributed to connected third-party platforms as described below. You may, subject to the limitations described in Section 5.4, change the visibility of any design to "Private" at any time.

5.2 Information Made Public

When a design is Discoverable, the following information may be made publicly available on the Service and on connected third-party platforms:

  • The AI-generated image associated with the design;
  • The textual description ("prompt") you provided to generate the design;
  • The style and other non-personal design parameters you selected;
  • A link to the design's detail page on the Service.

Information that personally identifies you — including, without limitation, your email address, account name, profile picture, payment details, and IP address — is not associated with, attached to, or otherwise transmitted alongside publicly distributed designs.

5.3 Third-Party Visual-Discovery Platforms

We maintain integrations with third-party visual-discovery platforms, including Pinterest, to which Discoverable designs may be automatically published. Once published to such a platform, designs may be viewed, saved, repinned, shared, indexed in search, and otherwise interacted with by users of that platform in accordance with that platform's own terms of service and privacy policy. We do not control, and assume no responsibility for, the practices of such third-party platforms, including any further redistribution, indexing, caching, or use of designs once published thereto. We encourage you to review the privacy policies of any third-party platform whose content you encounter through the Service. 5.4 Your Choices and Controls

You may change the visibility of any individual design between "Discoverable" and "Private" at any time, for as long as you maintain an account with the Service. Designs marked Private are removed from publicly accessible pages of the Service and are not, going forward, distributed to third-party platforms. Designs that were previously distributed to a third-party platform while Discoverable will be removed from such platforms following your election to mark them Private, subject to the technical processing time, propagation delay, and removal-API limitations of the relevant platform.

The ability to switch designs from Discoverable to Private may be made available, in whole or in part, only to users on certain paid subscription plans, as further described in our then-current subscription terms. Notwithstanding the foregoing, any user — regardless of subscription plan — may at any time submit a written request, directed to privacy@aifortattoo.com, to have any specific design, or all designs associated with their account, marked Private and withdrawn from publicly accessible pages of the Service and from connected third-party platforms. We will action such requests within a commercially reasonable period and in any event within the timeframes required by applicable data-protection law.

5.5 Try-On Photographs Excluded

Photographs that you upload to the Service for purposes of the tattoo try-on feature, together with any composite, layered, or enhanced images derived from such photographs, are not subject to the discoverability provisions described in this Section 5. Such images are treated as confidential to your account, are not displayed on publicly accessible pages of the Service, and are not distributed to third-party platforms.

6. Data Security

We implement appropriate technical and organizational measures to protect your personal data:

  • SSL/TLS encryption for data transmission
  • Secure cloud storage with encryption at rest
  • Regular security audits and updates
  • Limited access to personal data on a need-to-know basis
  • PCI-compliant payment processing through Stripe

8. Data Retention

We retain your personal data for as long as necessary to provide our Service and comply with legal obligations:

  • Account data: Until account deletion
  • Generated tattoo designs: Retained for the lifetime of your account; previously-distributed Discoverable designs may persist on third-party platforms after deletion subject to such platforms' own retention practices
  • Payment records: 7 years for tax compliance
  • Marketing data: Until opt-out or 2 years of inactivity

9. Children's Privacy

Our Service is not intended for children under 18. We do not knowingly collect personal information from children under 18. If you are a parent or guardian and believe your child has provided us with personal information, please contact us.

10. International Data Transfers

Your information may be transferred to and processed in countries other than your own. We ensure appropriate safeguards are in place for such transfers in compliance with applicable data protection laws.

11. California Privacy Rights

California residents have additional rights under the California Consumer Privacy Act (CCPA):

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date.
